Substance Abuse Professionals (SAPs) must utilize the Clearinghouse to report specific information about a CDL driver’s return-to-duty (RTD) requirements. This information includes the date of completion of the initial SAP assessment, and the date the SAP determines that the driver is eligible for RTD testing, per § 382.705(d).
Employers of safety-sensitive transportation employees have the responsibility to ensure the safety of their employees as well as the safety of the traveling public. This includes the developing and implementing successful DOT workplace drug and alcohol programs that have as their components clear policies, provisions for education and training, drug and alcohol testing, and when needed, referral for evaluation and treatment.
Employers must report within three business days after receiving notification of the following results; a confirmation of alcohol test resulting in alcohol concentration of 0.04 or greater, negative return to duty test result, and refusal to adhere to drug test (49 CFR § 40 Section 40.261).
Employers are required to provide a list of qualified Substance Abuse Professional (SAPs) to drivers in violation of the DOT Drug and Alcohol requirements.
As defined in 49 CFR § 40, The DER is an employee authorized by the employer for overseeing the removal of employees in violation of preforming safety-sensitive duties, making decision for the testing/evaluation process, and acts as a liaison for the employer.
A driver is considered any person who is licensed to operate a commercial motor vehicle. These drivers must remain in compliance with the DOT Drug and Alcohol requirements.
Drivers are required to enter their CDL information during their Clearinghouse registration. This allows them to view any violation or return-to-duty (RTD) information associated with their CDL.
Drivers must remain in compliance with the substance abused education, treatment, and drug test as required by the Substance Abuse Professional (SAP).
Drivers must successfully adhere to the Substance Abuse Professionals (SAPs) treatment requirements prior to final evaluation.
